SERVICES PROVIDED Art. 1. On the Site the Users have the opportunity to conclude a contract for purchase and sale and delivery of the goods offered by "GARMOTORSPORT.COM". REGISTRATION AND IDENTIFICATION "GARMOTORSPORT.COM" identifies the Users of the site by storing log files on the server of the Site and the IP address of the User. When filling in the application for registration, the User is obliged to provide complete and accurate data on identity (for individuals), legal status (for legal entities) and other data required by the electronic form of "GARMOTORSPORT.COM", as well as update them in 7 (seven) days from their change. The user declares that he agrees to provide the required personal data, ensuring that the data provided during the registration process are correct, complete and accurate and will change them in a timely manner if the latter changes. PRICE OF THE ORDER (1) The prices of the offered goods are those indicated on the website of "GARMOTORSPORT.COM" at the time of placing an order. The prices of the goods include VAT, in the cases where its charging is envisaged. "GARMOTORSPORT.COM" reserves the right to change at any time and without notice the prices of goods offered on the site, and such changes will not affect orders already placed. The change in the price is valid for consumers from the moment of its announcement on the website www.GARMOTORSPORT.COM (2) "GARMOTORSPORT.COM" may provide discounts for goods offered on the site in accordance with Bulgarian law and rules set by "GARMOTORSPORT.COM". The rules applicable to such discounts are available at the place where the discount is shown. WITHDRAWAL FROM THE CONTRACT AND REPLACEMENT The Consumer has the right to withdraw from the contract without stating a reason, without paying compensation or penalty within 14 days from the date of acceptance of the goods by the Consumer or a third party on behalf of the Consumer. In order to exercise his right under this clause, the User must unambiguously notify "GARMOTORSPORT.COM" of his decision to withdraw from the contract, individualizing the goods he wishes to return by providing all details of the order and delivery, including but not only: content and value of the order, data of the person who made the order, data of the person who accepted the delivery, and date of delivery. In accordance with the provisions of Art. 55 of the CPA, the consumer is obliged to store the received goods, their quality and safety until the moment of their return at www.GARMOTORSPORT.COM. in the form in which they were received. The consumer is obliged to return the goods at his own expense Upon return, the goods must be in their original packaging, without traces of use or distortion of trade (eg torn packaging, cellulose, removed labels, missing parts, etc.) and be accompanied by all accompanying documents - receipt and / or invoice, warranty card, instructions for use, etc. When returning the goods, the consumer is obliged to return all gifts received with the ordered goods, in case they are sent by "GARMOTORSPORT.COM". "GARMOTORSPORT.COM" has the right, at its sole discretion, to postpone the refund until the goods are returned or until proof is provided that the goods have been sent back, depending on which of the two events occurred earlier. In case the User does not fulfill his obligation to return the goods within the above period, without notifying "GARMOTORSPORT.COM" of any delay and without providing a valid reason for the same, it is considered that he has withdrawn his statement of exercise of withdrawal from the contract. When "GARMOTORSPORT.COM" has incurred costs in connection with the performance of the contract and the User withdraws from the contract, "GARMOTORSPORT.COM" has the right to withhold the relevant amount for the costs incurred or to demand their payment. The consumer has no right to withdraw from the contract if the subject of the same are: 1. for delivery of goods, made to order of the consumer or according to his individual requirements 2. for delivery of sealed goods, which are printed and / or tested after their delivery and cannot be returned due to reasons related to hygiene or health protection "GARMOTORSPORT.COM" refunds to the User the price paid by him for the returned goods. The transport costs for returning the goods from the customer to www.GARMOTORSPORT.COM are at the expense of the User. When the goods received by the User do not correspond to the characteristics specified in the page of the online store, are not used by the user in any way and have undamaged external factory packaging, the cost of returning the goods is at the expense of www.GARMOTORSPORT.COM. In this case, the customer must send the goods back to us. Upon request for return of goods (corresponding to the characteristics specified on the page of the online store), the transport is at the expense of the User. "GARMOTORSPORT.COM" refunds in full the value paid by the consumer of the returned goods not later than 14 days from the date on which the consumer has exercised his right of withdrawal under Art. 55 of the CPA. In case the customer has used a coupon / voucher for a discount, the customer is refunded only the amount actually paid by him. The value of the coupon / discount voucher is not refunded to the customer. WARRANTIES AND COMPLAINTS (1) The consumer has the right to claim for any discrepancy of the goods with the agreed / ordered, when after delivery, discrepancies are found with the contract of sale. "GARMOTORSPORT.COM" is not responsible for the difference in colors, which is due to the natural differences in the reproduction of colors from different models of monitors. All goods that are subject to warranty service are accompanied by the necessary documents with information about the warranty period (according to Bulgarian legislation), the conditions and place of warranty service. The consumer may not contest the conformity of the consumer product with the contract for its sale, when at the time of concluding the contract he knew or could not have been unaware of the non-conformity. (2) The consumer has the right to file a complaint against the goods, regardless of whether the manufacturer or the trader has provided a guarantee for the goods. When the satisfaction of the claim is done by replacing the product with another, corresponding to the agreed, "GARMOTORSPORT.COM" retains the original warranty conditions of the consumer. (3) Upon filing a claim for goods, the consumer may claim for refund of the amount paid, for replacement of the goods with another, corresponding to the agreed or for deduction from the price. The right to choose the place for filing the complaint belongs entirely to the consumer. The client should provide clear, complete and unambiguous information about the case in writing and within the legally established period for filing a complaint to the e-mail address: info@garmotorsport.com When filing a complaint, the user indicates the subject of the complaint, his preferred way to satisfy the complaint, respectively the amount of the claimed amount, and address, telephone and contact email. In order for the case to be resolved as soon as possible, it is advisable to attach photographic material (only if the case concerns a specific product (s)). After the case is reviewed and processed, you will receive a written response to the email address from which the complaint was filed (GARMOTORSPORT.COM is not responsible for any problems beyond our control of receiving the message within the statutory period). When submitting a complaint, the user must enclose a photo on which the claim is based, (5) The complaint of a consumer good may be filed up to two years from the delivery of the good, but not later than two months from the establishment of the non-conformity with the agreed. The period shall cease to run during the time necessary for the repair of the consumer goods or for reaching an agreement between the seller and the consumer for resolving the dispute. (6) If “GARMOTORSPORT.COM” has provided a commercial guarantee for the goods and the term of the guarantee is longer than the terms for filing the claim under para. 5, the claim may be filed until the expiration of the commercial guarantee. Filing a complaint is not an obstacle to filing a claim. (7) "GARMOTORSPORT.COM" maintains a register of complaints. A document is sent to the User on the e-mail specified by him, in which the number of the claim from the register and the type of the goods are indicated. When "GARMOTORSPORT.COM" satisfies the complaint, it issues an act to that effect, which is drawn up in two copies and must provide one copy to the User. (8) "GARMOTORSPORT.COM" in case of a valid complaint brings the goods in accordance with the sales contract within one month from the filing of the complaint by the User. If the goods are not repaired after the expiration of the term under the previous paragraph, the Consumer has the right to terminate the contract and refund the amount paid or to request a reduction in the price of consumer goods under Art. 114 of the CPA. Bringing the consumer goods in accordance with the sales contract is free of charge for the User. It does not owe costs for the shipment of consumer goods or for materials and labor related to its repair and does not suffer significant inconveniences. (9) In case of non-compliance of the consumer goods with the contract of sale and when the Consumer is not satisfied with the resolution of the complaint, he has the right to choose between one of the following options: 1. cancellation of the contract and refund of the amount paid by him; Price Reduction. The consumer may not claim a refund or a reduction in the price of the goods when the trader agrees to replace the consumer product with a new one or to repair the product within one month of the consumer's complaint. The trader is obliged to satisfy a request for cancellation of the contract and to refund the amount paid by the consumer, when after satisfying three consumer complaints by repairing the same product, within the warranty period, there is another occurrence of non-compliance of the goods with the contract of sale. The consumer may not claim cancellation of the contract if the non-conformity of the consumer product with the contract is insignificant. INTELLECTUAL PROPERTY (1) The intellectual property rights over all materials and resources located on the website of "GARMOTORSPORT.COM" (including available databases) are subject to protection under the Copyright and Related Rights Act, belong to "GARMOTORSPORT.COM" or to the respective indicated person, who has transferred the right to use “GARMOTORSPORT.COM” and cannot be used in violation of the current legislation. In case of copying or reproduction of information beyond the permissible, as well as in case of any other violation of intellectual property rights on the resources of "GARMOTORSPORT.COM", "GARMOTORSPORT.COM" has the right to claim compensation for direct and indirect damages in full . INVALIDITY CLAUSE The Parties declare that in the event that any of the provisions of these General Terms and Conditions prove to be invalid, this will not invalidate the entire contract or other parts thereof.
